Copyright & Intellectual Property Policy

1. Platform role
Solutionar operates a hosted e-commerce platform (the “Platform”) that enables merchants (“Operators”) to create and manage online storefronts. Solutionar acts as a hosting provider for Operator-generated content and does not review, curate, or exercise editorial control over that content before publication.
2. Reporting infringing content
If you believe that content published on a storefront powered by Solutionar infringes your copyright, trade mark, or other intellectual property right, please submit a written notice to:
Your notice must include all of the following:
- Your full name and contact details (postal address, telephone, email).
- Identification of the work(s) you claim have been infringed.
- Identification of the infringing material — URL(s) or a description sufficient to locate it on the storefront.
- A statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent, or the law.
- A declaration that the information in your notice is accurate and, where applicable, that you are the rights holder or authorised to act on their behalf.
- Your electronic or physical signature.
Incomplete notices that omit the above may not be actioned. Solutionar reserves the right to request additional information before processing a notice.
3. Response and takedown
We will acknowledge receipt of your notice within 2 business days. Where we determine a notice to be valid and sufficiently substantiated, we will disable access to the reported content and notify the Operator within 5 business days of receipt. We will inform you of the outcome once action has been taken.
4. Counter-notice
If you are an Operator and you believe content was removed or disabled in error, you may submit a counter-notice to legal@solucionar.eu explaining why the original notice was incorrect or that you hold the necessary rights. We will forward your counter-notice to the original complainant. If no judicial action is filed within 10 business days of our forwarding, we may reinstate the content at our discretion.
5. Repeat infringers
Solutionar will terminate the accounts of Operators who repeatedly infringe third-party intellectual property rights in accordance with applicable law.
6. Good-faith requirement
Notices submitted in bad faith — including knowingly false claims of infringement — may expose the submitter to civil or criminal liability under applicable law. Solutionar reserves the right to disregard manifestly unfounded notices.
7. Regulatory basis
This policy is designed to satisfy the notice-and-action requirements of Article 16 of Regulation (EU) 2022/2065 (Digital Services Act) and equivalent obligations under the national laws of EU and EEA member states. It is also aligned with the notice-and-takedown framework of the US Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
